It is information or an opinion about you, including your racial or ethnic origin, political opinions, membership of political associations, religious beliefs/affiliations, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual orientation or practices, criminal records and health information. 

As outlined in the Australian Privacy Act, sensitive information can, in most cases, only be disclosed with your consent.

  • candidate information submitted and obtained from you and from other sources in connection with your applications for work;

  • your working rights for Australia and relevant visa details;

  • information gained whilst receiving and carrying out-recruitment briefs and projects;

  • information obtained to assist in managing client and business relationships;

  • company and staff information;

  • information gained from the public domain such as corporate websites.

HOW INFORMATION IS COLLECTED

Personal and sensitive information will be collected from you directly when you submit a query or CV via our website, when you have an online, phone or face-to-face meeting with a Knight Fowler Jenkins consultant, when you submit your resume, when you apply for a job or when you take part in any testing.

Where practical, the purpose for which we collect personal information and the consequences of not providing it will be made clear at the time of collection.

Personal and sensitive information will also be collected when:

  • we receive or conduct any reference about you; 

  • we receive results of inquiries that we might make of your former employers, work colleagues, professional associates or registration body; 

  • we receive the results of any job-search specific competency, skills or medical testing; 

  • we receive performance feedback (whether positive or negative); 

  • we receive any complaint from or about you in the workplace; 

  • we receive any information about a workplace accident in which you are involved; 

  • we receive any information about any insurance investigation, litigation, criminal matter, inquest or inquiry which you are involved; 

  • you provide us with any additional information about you; 

  • you provide us with any additional information about you in the course of discussion with any staff member
    of Knight Fowler Jenkins.

HOW INFORMATION IS USED

Knight Fowler Jenkins holds, uses and discloses your personal information for the purpose(s) disclosed at the time
of collection, or otherwise set out in this Privacy Policy.

  • to match you with opportunities or to assist us in finding a position that is suitable for you and, where you provide your prior consent as a candidate, to send your personal information to our clients

  • our management and resolution of any complaint, inquiry or investigation in which you are involved;

  • to answer your inquiry;

  • to direct-market products and services, advise you of news and industry updates, events, promotions and competitions, reports and other information. Where we do so, you will be able to unsubscribe from such communications;

  • to inform you of possible work opportunities, relevant candidates, or other events such as training or information sessions by direct and addressed mail/email/SMS; 

  • career guidance or career management; 

  • to enable the development and marketing of other products and services and to improve our customer service and to make our services more valuable to you, including tailoring our website when you log on to make it relevant to you personally;

  • to trusted third parties where we have retained them to provide services that you have requested, such as psychometric evaluations or skills tests, and who also provide services to us, such as professional advisers, IT consultants, mailing houses and function co-ordinators. These third parties must comply with similar undertakings of privacy and confidentiality as Knight Fowler Jenkins;

  • our identification of your training needs; 

  • any insurance claim or proposal that requires disclosure of your personal or sensitive information;

  • undertaking criminal reference checks, employment checks and working-rights enquiries; 

  • for research, development, business systems and infrastructure testing, and other business purposes to assist us in providing our services to you;

  • if Knight Fowler Jenkins merges with or is acquired by another business, we may share personal information with the new owners of the business and their advisers. If this happens, you will be sent notice of such an event;

  • we may also release personal information to regulatory or law enforcement authorities if they require us to do so; and

  • we may also seek your consent to collect, hold, use and disclose your personal information for any other purpose not listed above

  • we may be limited in our ability to locate suitable work for you; 

  • we may be limited in our ability to place you in work;

  • we may be limited in our ability to provide recruitment or search and selection services to you and your employer’s business/firm or organisation

 

HOW INFORMATION IS STORED AND PROTECTED

We hold personal information in a combination of secure cloud and physical computer storage facilities, on paper-based files and other records.

We take such steps as are reasonable in the circumstances to protect the personal information we hold from misuse, interference and loss, unauthorised access, modification or disclosure.

We may need to maintain records for a significant period of time. However, when we consider information is no longer needed, we will remove any details that will identify you or we will securely destroy the records. Documents provided to clients contain a statement reminding them of the confidential nature of your personal information, as well as their obligation to comply with applicable national data privacy legislation.

HOW INFORMATION MAY BE DISCLOSED

Your personal and sensitive information may be disclosed to: 

  • potential employers and clients of Knight Fowler Jenkins; 

  • referees; 

  • other recruitment companies with whom Knight Fowler Jenkins may network from time to time;

  • our insurers; 

  • a professional association or registration body that has a proper interest in the disclosure of your personal and sensitive information; 

  • Workers Compensation bodies; 

  • our contractors and suppliers - e.g. our IT contractors and database designers; 

  • any person with a lawful entitlement to obtain the information; 

  • consultants and employees of Knight Fowler Jenkins

YOUR ACCESS TO PERSONAL INFORMATION

You may request to access, update or delete the personal information we hold by contacting the Knight Fowler Privacy Officer as below.

We may ask to verify your identity and for more information about your request. Where we are legally permitted to
do so, we may refuse your request and give you reasons for doing so. Where you request your personal information to be updated and there is a dispute about the facts, we will make a note on your personal information of such dispute. 
You may also request that Knight Fowler Jenkins stops using your information and stops contacting you and we will comply with your request. However, if this involves a request for deletion of your file, please be aware that we may not be required or able to do so, particularly where your file also holds information about our clients. We reserve the right to charge an administrative fee for access and updating requests.

Subject to some exceptions, which are set out in the National Privacy Principles (Principle 6 – Access and Correction), you have a right to see any personal and sensitive information about you that we hold. If you are able to establish that personal or sensitive information that we hold about you is not accurate, complete and up-to-date, we will take reasonable steps to correct it so that it is accurate, complete and up-to-date.

If we are unable to agree that personal or sensitive information that we hold about you is accurate, complete and
up-to-date, you may ask us to mark the information with a statement by you that claims that particular information is not accurate, complete and up-to-date. If you wish to exercise your rights of access and correction, you should contact our Privacy Coordinator whose details are shown below.

Knight Fowler Jenkins takes reasonable steps to keep personal information secure, accurate and up to date.
While we seek to protect your personal information by implementing digital security systems, we cannot accept responsibility for the security of information you send to or receive from us via websites or apps or for any unauthorised access or use of that information. Where we have links to websites outside our own, we cannot ensure that your privacy will be protected in accordance with this policy. You should consult these other websites' privacy policies as we have no control over them and are not responsible for any information that is submitted to or collected by these third parties.
